This small assignment from DOT&PF Southeast region is less about existing ROW research and more a discussion of ROW management. The question arose when a property owner adjoining Dyea Road in Skagway applied to DOT&PF for a driveway permit that would authorize access to the highway. A fairly straight forward process or so it seemed. In this scenario, there was a question regarding the authorities by which portions of the ROW were created, and whether those varying authorities might result in permitting authority by DNR as opposed to DOT or possibly even shared authority.
The report discusses the basis for the existing ROW and then delves into the difference between ROW ownership and management and the relationship between DNR & DOT with respect to permitting within these rights-of-way.
