Cartwright Road - 2010

Alaska Road Commission situation reports indicate that Moore-Cartwright road was staked in the Fall of 1952. A dependent resurvey and subdivision was performed in Section 19 & 20 of T.1S., R.1W., F.M for Small Tracts in April of 1953 and after completion of Cartwright Road construction in 1953. While many of the Small Tract lots were subject to a 33-foot wide patent reservation for roads and utilities, they were also subject to Secretarial Order No. 2665 that would have impressed a 50-foot wide right-of-way for "Local" roads where the federal lands in question were unreserved at the time.

This project involved the review and analysis of the title for the Small Tract lots adjoining Cartwright Road in anticipation of widening. As most owners may have believed that their Lot was only subject to a 33' wide patent based ROW along Cartwright, we needed to prove that a wider ROW existed. Note that this project was prior to the 2013 McCarrey v. Kaylor case in the Alaska Supreme Court that considered the basis and validity of Small Tract patent ROW resevations. As the SO2665 PLO ROW superseded the Small Tract reservation, no further consideration was required.
